Terms of Service
These Terms of Service ("Terms") are an agreement between Redmer Holding GmbH ("Curviate", "we", "us") and the person or organization that creates a Curviate account ("you"). They govern your use of the Curviate REST API, CLI, MCP server, SDK, and dashboard (together, "the Service"). By creating an account or using the Service, you agree to these Terms. If you're accepting these Terms on behalf of an organization, you confirm you have the authority to bind it, and "you" refers to that organization.
The Service
Curviate is agent-native LinkedIn infrastructure: a REST API, CLI, MCP server, and SDK that let you, and any AI agent or application you authorize, take actions on a LinkedIn account you connect, such as viewing profiles, sending messages, managing connections, and tracking engagement.
We don't scrape LinkedIn, and we don't operate on accounts we're not authorized to use. Actions run through native LinkedIn flows, paced to resemble ordinary human use, on the account you connect and control. You decide what to connect, what to configure, and what actions to take; we provide the infrastructure, we don't monitor, direct, or make those decisions for you.
The Service, and the specific actions and integrations it supports, may change over time as we add capability. These Terms apply to the Service as it exists from time to time, not to a fixed feature list.
Accounts, eligibility, and connecting LinkedIn
Curviate is provided for business and professional use. It is not intended for personal, family, or household use, and by creating an account you confirm you are using it in that capacity. You must be at least 18 and have the authority to enter into this agreement.
You're responsible for keeping your account credentials, API keys, and connector authorizations confidential, and for everything that happens under your account. Tell us immediately at security@curviate.com if you suspect unauthorized access.
You may only connect a LinkedIn account you own or are authorized to operate. Connecting someone else's account without their authorization is a breach of these Terms.
Because Curviate is intended for business use, the statutory 14-day consumer withdrawal right generally does not apply to your subscription. If, despite this, you are in fact contracting as a consumer under applicable law, that right is not affected by this paragraph.
Acceptable use
You agree not to use the Service to:
- Break the law, or infringe someone else's rights, including privacy and intellectual property rights.
- Send unsolicited, deceptive, or harassing messages, or otherwise violate anti-spam or data protection law, including GDPR, in how you use data you obtain through the Service.
- Impersonate another person or organization, or create or operate fake accounts.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, or bypass rate limits, authentication, or other technical controls.
- Resell, sublicense, or provide the Service to a third party as if it were your own product, without our written permission.
- Upload malware, or attempt to disrupt, overload, or gain unauthorized access to our infrastructure.
- Train a model on data obtained through the Service, or use the Service to build a directly competing product.
You are responsible for the content of every message, comment, and connection request sent through your account, and for making sure your use of the Service, and of any data you obtain through it, complies with the law and with the terms of the platforms you connect.
LinkedIn and other third-party platforms
Curviate is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation or Microsoft. "LinkedIn" is a trademark of LinkedIn Corporation; we refer to it only to describe what our Service interoperates with.
LinkedIn's own User Agreement and Professional Community Policies restrict certain automated and high-volume activity, and enforce those restrictions through technical measures and account actions, up to and including restricting, suspending, or terminating an account. Curviate is designed to reduce that risk: actions run through native flows, paced to resemble organic use, with a gradual warmup for new accounts. That design lowers the risk; it does not remove it, and we have no special permission from LinkedIn that exempts you from its enforcement.
You are solely responsible for ensuring your use of the Service complies with LinkedIn's terms and policies, and for any consequence LinkedIn imposes on your account as a result. If you're unsure whether an intended use is consistent with LinkedIn's rules, check LinkedIn's own policies, or don't do it.
The same principle applies to any other third-party platform, tool, or data source you connect to or through the Service.
Connecting an AI agent or app
Curviate is built to be used by AI agents and automated clients as much as by people directly. When you issue an API key or authorize an OAuth connector, for example to connect an AI agent like Claude, or your own code, to your workspace, that agent or application can take any action within the access you granted, exactly as if you had taken it yourself.
You are responsible for the actions taken by any agent, application, script, or other party you authorize to access the Service, including the content of messages it sends and the data it retrieves. We don't control or review what a connected agent decides to do; you do, through the access and instructions you give it.
We don't provide the AI model itself; we provide the infrastructure it calls. What a connected agent or application does with data it receives back from the Service, including anything it sends to its own AI model, is governed by that agent's or application's own terms and privacy practices, not ours.
You can review and revoke any API key or connector at any time from your dashboard; revoking one ends its access immediately.
Fees, billing, and free trial
Curviate is offered on subscription tiers billed per connected LinkedIn seat, with add-ons that unlock capabilities like Sales Navigator or Recruiter actions, monthly or annual. Current pricing is on our pricing page; using the Service after a price change takes effect means you accept the new price, and we'll give you notice before a change applies to your next renewal.
New workspaces may be eligible for a one-time free trial. We may limit, deny, or end a trial we reasonably believe is being used to evade trial limits, and reserve the right to change or discontinue trials generally.
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Adding seats or upgrading a tier is billed immediately, prorated for the rest of the current period. Removing seats or downgrading takes effect at the end of the current period, with the seat or tier remaining active, and billed, until then; we don't provide partial refunds for time already paid for.
Fees are non-refundable except where required by law. If a payment is disputed or reversed without you contacting us first, we may suspend write access to your account while we investigate.
Data and privacy
How we collect, use, and retain personal data, including cookies, is described in our Privacy Policy, which is part of these Terms. In short: for your own account data we are the controller; for the LinkedIn data you act on through your connected account, you are the controller and we are the processor, under a Data Processing Agreement available on request.
Intellectual property
We own the Service, including our software, API, documentation, and brand. We grant you a limited, non-exclusive, non-transferable licence to use it for your own business purposes for as long as your subscription is active; you may not resell, sublicense, or otherwise make it available to third parties as a standalone product.
You own your own content and data. If you send us feedback or suggestions, you agree we can use them to improve the Service without owing you anything for it.
Warranties and disclaimers
The Service is provided "as is" and "as available." We don't warrant that it will be uninterrupted, error-free, or secure, that data obtained through it, including LinkedIn data, will be accurate or current, or that using it will produce any particular outcome, lead, or result. LinkedIn, and any other third-party platform, may change its systems, APIs, or policies at any time in ways that affect the Service, and we're not responsible for the effects of changes outside our control.
To the extent the law doesn't allow us to disclaim a warranty, that warranty is limited to the shortest period and narrowest scope the law allows.
Liability
We are liable without limit for intent and gross negligence, for injury to life, body, or health, and under the German Product Liability Act, regardless of fault.
For ordinary negligence, we are liable only for breach of an essential contractual duty, one whose fulfilment makes proper performance of this agreement possible in the first place and on which you may reasonably rely, and then only for the foreseeable damage typical for a contract like this one.
Beyond that, and to the extent the law allows, our total liability for all claims arising out of or relating to the Service is capped at the fees you paid us in the three months immediately before the event giving rise to the claim.
We are not liable for indirect or consequential damages, such as lost profits or lost business opportunities, for the accuracy or completeness of data obtained from LinkedIn or another third-party platform, or for LinkedIn's decision to restrict, suspend, or terminate your LinkedIn account. These exclusions don't apply to the unlimited liability described above.
Indemnification
You will indemnify us against claims, damages, and reasonable costs, including legal fees, that a third party, including LinkedIn, brings against us arising from: your breach of these Terms; your use of the Service in violation of the law or a third-party platform's terms; content, instructions, or data you provide, retrieve, or send through the Service; or actions taken by an AI agent, application, or other party you authorized to access the Service. This doesn't apply to the extent a claim results from our own intent, gross negligence, or unlawful conduct.
Suspension and termination
You can stop using the Service and close your account at any time from your dashboard.
We may suspend or restrict your access if we reasonably believe you've breached these Terms, your use poses a security risk to our infrastructure or other customers, or we're required to by law. Where we can, we'll tell you why; where continuing access would create legal or security risk, we may act first and explain after.
We may also discontinue the Service, or a part of it, with reasonable advance notice where practical. If we end your subscription for a reason other than your breach, we'll refund fees you've prepaid for the period after the end date.
When your account closes, your data is handled per the retention timeline in our Privacy Policy: recoverable for 7 days, then permanently deleted on day 8. Export anything you need before then.
Changes to these Terms
We may update these Terms as the Service evolves. We'll give you notice of material changes before they take effect, by email or in the dashboard. Continuing to use the Service after a change takes effect means you accept it; if you don't agree, stop using the Service and cancel your subscription before the change applies.
Governing law and jurisdiction
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. For business customers, the courts of Bonn, Germany have exclusive jurisdiction over any dispute. If you're contracting as a consumer under applicable law, any mandatory consumer-protection rules of your own country of residence, including your right to bring proceedings in your local courts, are not affected by this clause.
General terms
If any part of these Terms turns out to be invalid or unenforceable, the rest remains in force, and the invalid part is replaced with something as close as possible to what we intended.
Not enforcing a right under these Terms isn't a waiver of it. You can't assign or transfer your rights under these Terms without our written consent; we may do so as part of a merger, acquisition, or sale of our business. Neither of us is the other's agent, partner, or joint venturer.
Neither of us is liable for a failure or delay caused by circumstances reasonably beyond our control, such as a natural disaster, war, or an internet, infrastructure, or third-party platform outage.
These Terms, together with our Privacy Policy and any Data Processing Agreement, are the entire agreement between us about the Service, and replace any earlier discussion or agreement on the same subject.
